传统医学法律保护之路径选择及其对我国传统医学的启示 被引量：1

摘要 国际法上传统医学的保护路径的选择决定于其为国际法所确认的民族传统文化属性。国际人权法应当成为传统医学的主要法律保护工具。具有鲜明的中华民族传统文化属性的我国传统医学的法律保护应当选择以人权法为主,以包括知识产权法保护在内的其他法律保护形式为辅的路径。
