摘要
行政补偿在我国法治建设中是建立较早的一项法律制度 ,但时至今日 ,在制度完善方面还有大量的工作要做。本文从行政补偿制度历史渊源、思想基础以及学理依据、建立完善的行政补偿制度的宪法根据入手 ,力图澄清行政法理论界存在的对于行政补偿制度的若干片面理解 ,为行政补偿法的立法实践提供理论基础 ,推动相关立法实践的发展。
Administrative compensation is a law system established relatively early in our country's legal system construction. However, there is still a great deal to do to perfect this system. This essay aims to clarify some one sided interpretations of administrative compensation that can be found in the theoretical field of the administrative law, to provide a theoretical basis for the law making practice of the administrative compensation law, and to quicken the development of related law making practice.
