摘要
最近学术界围绕“亲亲相隐”的问题,引发了一场如何认识、评价儒家伦理的讨论,涉及到如何看待血缘亲情,以及孔孟等儒者是如何处理血缘亲情与仁义普遍原则的关系等一系列问题。(参见郭齐勇主编,2004年;2011年)对此,学者已发表了不少高见,澄清了一些问题。但总体上看,该次讨论更多的是一场“立场之争”而非“学术之争”。其实对于“亲亲相隐”这一复杂的学术问题,辨明“事实”比作出“评判”更为重要,“立场”应建立在“学术”的基础之上。值得注意的是,近年出土的简帛文献中涉及到与“亲亲相隐”相关的内容,为我们理解这一学术公案提供了重要的材料。本文拟结合新出土材料以及前人的讨论,对“亲亲相隐”尤其是儒家对于血缘亲情的态度和认识,作一深入、系统的分析和梳理。
The concept zhi in The Analects have two meanings,frankness and justice.As one of the virtues,zhi,also called zhidao,means a practical process from emotion to reason.It argues that zhi in the sentence of 'zhi is to be found in this' does not mean justice,but mean frankness.In the excavated documents,the early Confucians proposed to prevent the parents from faults by advices and criticisms.When the advices and criticisms do not work,the sons should conceal the fathers' faults and take the responsibility themselves.Zi Si only proposed to conceal the minor faults in the Article Wuxing(Five Elements),while Meng Zi extended the faults to murder,which demonstrates the conflicts between emotion and reason.
