摘要
随着计算机软件产业的飞速发展,计算机软件日益受到任意复制与盗版的侵害,严重挫伤了开发者的积极性与创造性,危及产业的健康发展。对软件著作权实施有效保护已迫在眉睫。如何更加准确地对软件著作权侵权行为进行认定是解决计算机软件著作权纠纷的重点和难点问题。对此,应从法律和技术两个层面入手,完善软件著作权侵权的准确认定。
The copyright infringement of software is getting serious, which affects the development of software and software industry. It has been accepted that the software copyrights shall be protected, but the problem of how to identify infringement behaviors of software copyrights has not been resolved, which is the key issue as well as the difficult point to protect the copyright. The identification of infringement behaviors shall be performed in legal and technical angles.
