摘要
分析国防工业合作创新的类型与发展特点。系统比较国防知识产权与普通知识产权间的主要差别,突出强调国防知识产权的政治性和公益性。从产权模式、产权特性等方面,全面剖析国防知识产权制度对国防工业合作创新的影响,指出目前的国防知识产权制度体系缺乏对知识产权风险等问题的有效约束和规范,不足以对国防合作创新形成有效激励。最后,提出国防知识产权法律体系和管理制度改革、完善的建议。
This paper firstly analyzes the types and development features of cooperative innovation for national defense industry. It systematically compares the difference between military and traditional intellectual property, and emphasizes the political nature and public welfare of military intellectual property. This paper also analyzes the influence of intellectual property on cooperative innovation from its mode and features. The result shows that the current system can＇ t efficiently control and manage the intellectual property risks and encourage cooperative innovation. Finally, it gives suggestions for the reform and perfect of intellectual property law system and management system.
