摘要
从1995年《食品卫生法》明确将保健食品纳入管理范畴,2005年《保健食品注册管理办法(试行)》出台,到2009年《食品安全法》实施并严格保健食品的监管,我国保健食品监管制度经历了不断建设的发展历程。随着监管制度体系的逐渐完善,我国保健食品产业在历经了几次较大的波动后,目前已逐渐步入规范发展阶段。文章探讨了我国保健食品监管制度的发展变化,尤其是对监管体制和职能的演变、政策与法律法规的完善、允许申报功能的改革和批准文号的调整四方面进行了分析。通过研究,文章提出两点思考。第一,应进一步完善标准体系;第二,应加强广告宣传的规范。
Followed the time advancement,Chinese supervision system for health food has been constantly developed and improved from 1995,when Food Hygiene Law governs health food explicitly and Regulations for the Registration and Management of Health Food releases in 2005,until the implementation of Food Safety Law in 2009 . Along with the transformation of our supervision system , China ’ s health food industry has undergone major fluctuations,showing the development trends of standardization. The development of Chinese supervision system for health food was discussed in this paper,especially the evolution of regulators and regulatory functions,the perfection of the policies and regulations,the reformation of declaratory functions and adjustment variation of approval numbers. Finally,two suggestions were put forward. The first was to further complete the standard’s system. The second was to strengthen standardization for advertisement propaganda.
