摘要
侵权法的预防功能一直被学界忽视,被认为是补偿功能一个令人满意的"副产品"。这是对预防功能的一个重大的误解。预防功能应作为侵权法的首要功能而被重视。预防功能有其特殊的实现方式和独特的价值,它侧重于向前看,鼓励侵权人和受害人采取预防措施减少不必要的侵权行为并促使侵权行为数量处于社会最佳水平。强调侵权法的预防功能,以其为侵权法的核心功能来更新和重构当代侵权法的理论体系,无疑是克服当今侵权法危机的一条明智之路。
The prevention function of the Tort Law is neglected by the academy and regarded as a satisfactory ＂by-product＂ of compensational function. This is a great misunderstanding of it. Preven- tion function should be regarded as the major one of the Tort Law and it has special realization method and value. It focuses on a look forward, encourages tortfeasors and the victims to minimize unnecessary infringement by taking prevention measures and control the number of the infringements to optimal social level. The emphasis on the prevention function as the core function can help reno- vate and reconstruct contemporary Tort Law system in order to overcome the crisis the Tort Law con- fronts.
