摘要
澳大利亚在对其版权法的多次修订中均涉及到图书馆的版权保护问题,在图书馆使用版权方面积累了较为成功的经验。澳大利亚首先对适用版权的图书馆性质进行了界定,并规定了图书馆版权流转的规则:合理使用;照顾公共利益;商业供应检验法等。除此之外,澳大利亚还实施知识共享许可协议来解决公共部门信息获取与再利用中的版权保护问题。文章对此进行了分析,并揭示其对我国图书馆界的借鉴意义。
The problem of library＇s copyright protection is referred during the course of Australian copyright＇s several edits.As to library using copyright,many successful experiences have been accumulated in Australia.Firstly,the library＇s applying copyright character is defined in Australia,and the regulations of library using copyright are stipulated as followings：fair use;care for public interests;test law of commercial supply.Besides,the Creative Commons License is implemented to settle the copyright protection problem in public sector information access and reuse in Australia.The paper analyzes these problems and reveals its references for library in our country.
