摘要
对道地药材的认知首先要分析其无形资产的内涵。运用知识产权的基本原理和法学理论,根据道地药材的基本属性,论述了道地药材的名称是知名商品中的特有名称;道地药材本身是我国具有优势地位、具有一定稀缺性的生物遗传资源;道地药材中包含着市场经济下医药经营者拥有的专有技术;其蕴含的传统药物知识属于典型的传统知识。
To analyse the intangible assets is the first step to recognize the Chinese endemical herbal medicine. In order to research legal question of Chinese endemieal herbal medicine from concept of intangible assets, we use the basic principles of intellectual property and law theory. We summarized that Chinese endemical herbal medicine is our country＇ s preponderant and rare genetic resource. They have many know-bows owned by operators in market-oriented economy. They contain traditional medical knowledge which belongs to traditional knowledge, and the name of every Chinese endemical herbal medicine is unique name of well-known commodities.
