互联网服务具有不同于传统实体经济的新特点,从而决定了互联网服务的市场支配地位认定不同于传统行业。通过考察欧盟和美国的行政执法和司法实践,能够为我国互联网服务的市场支配地位认定提供以下启示:服务的免费属性不是否定市场支配地位的合理解释,一边市场的支配地位不能推断出另一边市场的支配地位,市场份额的计算要考虑销售量(额)之外的其他指标,市场进入障碍的分析要以网络效应为基础。
Different from traditional real economy, Internet service has new features. So determination of dominant market position of Internet service is different from the traditional industry, Through researching law enforcement and judicial practice of the EU and the USA, China can conclude some enlightenment to determinate dominant market positions of Internet service. We should not deny the dominant market position even if Internet service is free;While there is a dominant market position in one side of the market, we cannot assume another dominant position in the other side of the market; To calculate the market share, we should consider other indicators except sales;The analysis of market entry barriers should be based on network effect.
