摘要
通过对一起工程建设领域典型违法案例处置过程的清晰描述,展示了柔性监管理念下工程质量监督人员在取证、释疑、分析、推理、论证、实施阶段复杂、矛盾的自由心证过程以及与行政相对人沟通、应变、博弈进而有效实现管理目标的完整历程,阐明法理并提出了督导并举、服务至上的改革思路。
This paper demonstrates the complex and contradictory mental process of free evaluation of the supervision staff with flexi- ble supervision concept in their evidence collection, explication, analysis, reasoning, argumentation and enforcement in engineering quality supervision via a typical illegal case in engineering construction. It also keeps tracks of the whole process of the staff's com- munication, discussion and even gaming with their administrative counterpart to reach their goal of management effectively. Laws are illustrated and the reform notion of "Supervision with Persuasion and Service Uomost"is nronosed.
