摘要
经济犯罪追赃能保护被害人的利益,化解社会矛盾,能打消企图通过经济犯罪致富的心理,进而预防犯罪。针对实践中存在着追赃积极性不高、方法不得力等问题,笔者建议确立"人赃并重"、保护所有权与促进交易安全相结合的追赃原则,构建经济犯罪的涉案财物的保全性扣押制度、有限的审前发还制度以及单独没收制度以加强对赃款赃物的司法控制。
Disgorgement of illegal gains serves to protect the benefits of victims, solve social contradictions and e- liminate the attempts to become rich by means of economic crimes so as to prevent crimes. Therefore,disgorge- ment can bring about good social effects. Since there exist such problems as low incentive of economic disgorge- ment and poor methods, the paper suggests some countermeasures,including the principle of equal attention to e- conomic suspects and spoils, protection of ownership of goods and transaction safety, the protective seizure of confiscated property, limited return of confiscated property before trail and separate confiscating system to strengthen the judicial control over the booty of economic crimes.
