摘要
通过考察大陆法系、英美法系和中华法系代表性国家法律解释权的配置状况,可以发现法律解释权配置演变的规律,即法律解释权的基本概念从模糊走向明确,法律解释权的配置目的从集权走向分权,法律解释权的行使主体从多元走向一元,法律解释权的行使方式从神圣走向世俗。深入分析影响法律解释权配置的内在因素可以看到,政治体制是左右法律解释权配置的总体框架,法律状况是制约法律解释权配置的具体条件,解释原理是支配法律解释权配置的内在规律,历史事件是改变法律解释权配置的直接动力。法律解释权配置演变的规律给人们的启示在于,法律解释权的配置应当遵循法律解释原理和规律,法律解释权的配置应当与法制状况相适应,法律解释权的配置应当结合现代法治精神。
Investigating the configuration of legal interpretation power of the representative countries in Conti- nental legal system, Anglo-American legal system and Chinese legal system, we can discover the evolution regular pattern of the configuration of legal interpretation power as the follows ： the basic concept of legal interpretation power from fuzzy to clear, the purpose of configuration of legal interpretation power from centralization to decentralization, the exercise subject of legal interpretation power from multiple to single, the exercise way of legal interpretation power from the sacred to the secular. According to depth analysis on internal factors influencing the allocation of legal inter- pretation power we can see, political system is the overall framework which control the configuration of legal interpre- tation power, legal status is the actual conditions which restrict the configuration of legal interpretation power, inter- pretation principle is the internal rule which dominate the configuration of legal interpretation power, historical events is the direct motivation which change the configuration of legal interpretation power. The inspiration of the evolution of configuration of legal interpretation power are the follows ： The configuration of legal interpretation power should follow the principles and rules of legal interpretation, the configuration of legal interpretation power should in con- formity with legal status, and the configuration of legal interpretation power should combine with the spirit of modern rule of law.
