摘要
本文从法律的实际执行、司法解释面临的难题、某些管制目标的异化三个方面分析了劳务派遣立法体现出的某种观念逻辑与现实逻辑的冲突。当构建和谐劳动关系的立法宗旨被理解为主要依赖公权力介入时,出现了问题越多越管、越管越多的尴尬局面。反思劳动立法的思维定势,重新定位"劳动关系和谐"与"劳动关系稳定"的相互关系,找准国家与市场的联接点,才可能恰当地应对劳务派遣产生的问题。
This article analyzes the conflict of the logic and reality about labor dispatch legislation from the actual execution of the law,judicial interpretation problems and some control goal alienation.When the legislative purpose of building a harmonious labor relationship is understood as the main rely on the public power intervention,it would appear embarrassing situation of the management the more questions.Reconsidering the thinking set of labor legislation,relocation the interrelations of 'harmonious labor relations'and 'stable labor relations',finding the joining points of state and market,we will properly deal with the problem of labor dispatch.
