摘要
知识产权管理在整个知识产权工作中起着全局性的重要作用,但在国家知识产权战略实施过程中,仍然存在着"创造、运用、保护和管理"之间进展失衡,系统建构知识产权管理理论,加强知识产权管理政策体系研究是进一步推进知识产权战略实施、增强我国自主创新能力和建设创新型国家的基础保障。文章提出了包含权利、财产和资源形态的知识产权管理对象体系,并以此为基础建构了以管理者、管理对象和管理过程为维度的知识产权管理内涵框架。同时根据我国知识产权管理的现行政策模式,从知识产权行政管理和市场主体知识产权管理的角度,对目前我国知识产权管理存在的问题进行了梳理和总结。最后,提出了我国加强知识产权管理的政策体系和保障机制,并着重就建构高效的知识产权行政管理机制、强化市场主体知识产权能力和规范知识产权服务机制等重要内容提出具体的政策建议。
In China＇ s national intellectual property strategy, Intellectual Property Management （IPM） should play its core role in the whole IP systems. As the weak and difficult part, IPM has become the bottleneck to limit improvement of IP creation, exploitation, protection. This paper firstly proposes an object system of IPM including rights, property, and resources, with multidisciplinary perspectives. Then, we present an empirical study on the evolution of public policy of IPM since 1994 to 2010. Meanwhile, according to the concept system of IPM, we analysis and summarize several key problems of our IPM practices in administration and right-owner management. Finally, we try to put forward a series of policy suggestions, especially in administration, management, and public service aspects of IPM
