摘要
根据国际经验,惩罚性赔偿是治理食品安全问题的有效措施。我国尽管已在立法当中引进了这一制度,可实践效果却令人失望。究其原因,是由于我国对于惩罚性赔偿的立法不够科学,在行权条件、数额量定、实施方法等环节的设定上存在漏洞。因此,当务之急在于充分借鉴国外成熟立法例,对我国食品安全诉讼当中的惩罚性赔偿规则予以重塑。
Based on international experience, the mechanism of punitive damages has made great success on the safeguard of food safety. Although we have introduced punitive damages into our laws, the result of execution is such a disappointment in China. The reason mainly relies on the unscientific and irrational legislation in punitive damages, which results in countless loopholes when applying the rules. Hence, importing the successful oversea experience accurately and integrally is the top priority.
