法律手段协调劳动关系可行性评估——以辽宁省为例探讨化解劳资双方矛盾之法律对策

摘要 针对有效化解劳资双方矛盾、以法律手段协调劳动关系的调研成果,通常倾向于现象描述分析手段为主,未能深入挖掘相关问题的根源,在理论层面逻辑自洽地循环式推演。劳动关系协调程度的优劣关系到劳动者相关宪法权益维护、呼应社会主义市场经济体制良性劳动关系的建立。已有研究脚本更擅于理论层面探讨,定量研究尚不足以支撑论证相关配套政策的合理性,闭门造车而缺乏针对性、翔实的一线调研数据。 Research results to effectively resolve conflicts between employers and employees and to coordinate labor relations by legal means, usually tended to describe and analyze the phenomenon, but failed to dig deeper the root of the problem, which is the logical cyclic deduction at the theoretical level. The degree of coordinating the labor relations is related to the merits of the protection of relevant constitutional tights of workers, echoing the establishment of sound labor relations in socialist market economic system. The ex- isting research has been better at the theo- retical level, quantitative research is still in- sufficient to support the argument of the reasonablity of related policies, lack of spe- cific and detailed survey data.
