摘要
我国《信访条例》赋予行政信访政治参与、权利救济和怨情排解功能,而行政信访在实践中承担各种各样功能,其中主要功能是维持社会稳定,信访实践偏离了《信访条例》对行政信访的功能定位。政治参与应是行政信访的主要功能,次要功能是权利救济,监督行政与解决纠纷是信访的间接功能。我国应当根据行政信访的功能定位设置信访机构,将信访机构统一设置在人民代表大会内不符合我国国情,政府内部设置一个相对独立的信访机构是恰当的选择。应赋予信访机构主体资格,信访人可以针对信访机构不予答复的信访事项提起行政诉讼。
Political participation, right relief and resolution of complaints are the functions endowed by rule. In practice, administrative complaining takes on a wide range of functions, among which the main function is to maintain social stability. While the political participation is the main function of administrative complaint, the secondary function is to relieve the citizen fight, and supervising the administrative and resolving dispute ale the indirect functions. The petition for unified body arranged in the People' s Congress is not in line with Chi- na' s national conditions. The government internally provided with a relatively independent petition mechanism is the fight choice. The mechanism should be given the main body qualification, and the person can institute an administrative lawsuit in response to the complaining items which received no reply from the petition organiza-tions.
