摘要
我国夫妻共同债务认定规则的设计,在价值理念上应以寻求婚姻家庭利益和社会利益和谐统一为指针,在认定标准上采实质主义,以所负债务用于婚姻家庭共同生活为旨归。在内容上明确对因"家庭共同生活"所负债务予以类型化划分,在立法体例上参照婚姻法有关认定夫妻共有财产的编排体例,对夫妻共同债务之认定采概括、列举和排除体例的形式,在证据规则上采举证责任倒置主义,公平分配证明责任,以实现对夫妻双方财产权益和债权人利益衡平保护之目的。
The reconstruction of the rules of marital common debts shall pursue the harmony between marl- tal benefits and social interests, and take the debts＇ purpose as a standard which the debts shall be used for marital life. The marital common debts rules shall definitely make distinction by the types of debts for marital life, and establish the legislative styles by applying generalization, particularization and exclusion followed the styles of the family law concerning marital common property. In lawsuit, it shall adopt the rules of inversion of onus probandi, and distribute the burden of proof equitably to equally protect the marital benefits and debtors＇ interests.
