摘要
全球金融危机后,英国进行了系统而彻底地金融监管改革,进一步强化了对金融消费者的保护。《2012年金融服务法案》正式撤销了金融服务局,将其职能分拆由金融行为局和审慎监管局两个机构承担,从体制上实现了金融消费者保护与审慎监管职能的分离。同时,金融行为局被赋予了产品管理和干预权、产品和服务推广限制权、实施有利于市场竞争的监管政策等一系列新的权利。英国的金融监管改革对我国完善金融消费者权益保护机制具有重要的启示意义。
To strengthen the protection of financial consumers, the UK government launched a series of systematical and thorough financial regulatory reforms after the global financial crisis. The Financial Services Act 2012 formally withdrew the FSA and split its functions into the FCA and the PRA, resulting in the separation between financial consumer protection and prudential supervision in the regulatory regime. Moreover, the FCA was granted a series new regulatory power, such as managing and intervening financial products, restricting financial promotions and embedding competition in regulatory approaches. The UK's financial regulatory reform has an important implication for the improvement of China's financial consumer protection mechanism.
