摘要
单一的著作权保护已经无法满足我国文化创意产业发展的需要,应该建立多种形态知识产权相互协同的知识产权保护策略。文化创意产业的"文化"、"创意"、"产业"三维本质,以及知识产权自身所具有的客体无形、种类多样、功用互补的特点,共同决定了文化创意产业知识产权保护策略的内容架构。文化创意产业知识产权保护策略的建构,应该以著作权为核心,以专利权、商标权、商业秘密权和反不正当竞争权为辅助因素。充分获得并有效保护各种形态的知识产权以促进文化创意产业的发展,是知识产权保护策略建构的出发点和归宿。政府职能部门、行业协会和创意企业应该各自发挥其职能,共同推进文化创意产业知识产权保护策略的科学建立和有效运作。
Single copyright protection has been unable to meet the needs of the development of cultural and cre- ative industry in China, so the compound and cooperative intellectual property protection system should be set up. The three dimensional nature of "culture", "creativity", "industry" of cultural and creative industry, and the characteristics of invisible object, species diversity, and functional complementation of the intellectual prop- erty, jointly determine content architecture of the intellectual property strategy of cultural and creative industry. The construction of intellectual property protection strategy of cultural and creative industry should take copyright as the core, and the patent rights, trademark, trade secret right and anti-unfair competition strategy as the auxil- iary factors. How to effectively obtain and protect the different forms of intellectual property to promote the devel- opment of cultural and creative industry is a central problem in the construction of intellectual property protection strategy. The government, industry associations and creative enterprises should play their respective roles in or- der to jointly promote the construction and effective operation of the intellectual property protection strategy.
