摘要
本文从两个方面讨论了最高额抵押的使用范围,一是概括最高额抵押权的效力,一是被担保债权的资格。笔者认为在确定最高额抵押范围时,必须注意权利平衡。既要注意保护抵押权人的利益,又要保护抵押人及其他利害关系人的利益。
The application scope of maximum mortgage is discussed from two aspects, one is that the effect of maximum mortgage is summarized, the other is the eligibility of the obligatory right guaranteed. When the scope of maximum mortgage is determined, we must pay attention to the fight balance. Not only the interests of the mortgagee should be protected, but also the interests of the mortgagor and other stakeholders should be protected.
