摘要
深入分析了改革开放以来违法建设行政处罚制度的发展过程,指出当前违法建设难以遏制的制度根源就是行政处罚缺乏必定性和相当性,只有解决了这一问题,才可能从根本上改变违法建设的严峻局面。
The paper analyzes in depth the development process of administrative penalty institution on illegal construction since the reform and opening up of China, and then points out that the institutional root for the failure to control the illegal construction lies in that the administrative penalty lacks inevitability and correspondence. Only solving this problem can the serious situation of illegal construction be altered ~ndamentally.
