摘要
《民事诉讼法》修订之后,虽然将民事执行检察监督写入法律,但关于监督范围、监督方式等方面的规定缺失,缺乏可操作性,使检察实务中对执行监督的实效大打折扣,为民事执行检察监督带来了极大困扰。应尽快完善相关规定,推进民事执行检察监督工作。
Although the prosecutorial supervision of civil execution has been included in the amendment of Civ- il Procedural Law, it is short of the rules about the scope and mode of supervision. This makes it not operative and brings much trouble to the proseeutorial supervision of civil execution. The author intends to analyze the plight and status quo of civil execution supervision and to put forward some suggestions for perfecting the relevant provisions.
