摘要
本文从古希腊故事讲起,围绕着"恶法非法"这个问题展开探讨,对自然法学派和实证法学派进行评述,并结合我国法制实践,提出"恶法亦法",但是"恶法"必须得到改进。
From two ancient Greek stories, this paper makes comments on the differences between the view- points of the natural law school and the positivist school, centering on the question of ＂lex injusta non est lex＂. Based on the legal practice in China, this paper puts forward that unjust law is still law though it should be per- fected.
