摘要
平潭综合实验区的极其特殊性决定了其先行先试离不开授权立法。《关于支持福建省加快建设海峡西岸经济区的若干意见》、《海峡西岸经济区发展规划》和《平潭综合实验区总体规划》等中央文件不是直接的授权决定,但其为平潭综合实验区的授权立法提供了政策支撑。平潭综合实验区授权立法的授权主体应是全国人大,被授权主体应是福建省人大及其常委会和省政府;授权内容当前应从《平潭综合实验区总体规划》的"改革开放"和"保障措施"中的相关事项中选择,一事一授权;授权的方式应将主动授权和依申请授权相结合;授权决定方式应具体明确。
Abstract: The Pingtan comprehensive experimental zone has exceeding particularity, which decides that the authorized legislation concerning the zone is the necessity to the priority to carry and try many new measures. The following documents, i.e., " The State Council's plan to support the development of an economic zone on the western side of the Taiwan Straits" ," The channel west bank economic zone development planning"," The overall planning of Pingtan comprehensive experimental zone" are not directive authorized legislation, but they provide the policy support for authorized legislation concerning Pingtan comprehensive experimental zone. The subject to authorize the authorized legislation concerning Pingtan comprehensive experimental zone shall be the National People's Congress; The Authorized subject should be Fujian people's congress and its standing committee as well as the provincial government; Authorized content should be among the relative items which lies in the chapter of" reform and open " and "safeguard measure" of "The overall planning of Pingtan comprehensive experimental zone" ,"one case one authority ", and it should be given in the way of combining initiative-authority and applied-authority in detail.
