摘要
诞生于20世纪初期的图书馆版税制度,1972年在德国被率先融入著作权法,后经历长期的制度演变和技术革新,逐渐发展完善,并成为欧盟(欧共体)及其成员国在著作权保护和制定公共借阅权补偿金制度时加以仿效的模板。随着信息时代面临的数字版权、计算机软件外借、电子书外借、复制传递、分配公平性等多方面障碍越来越凸显,德国图书馆版税制度的适应性变革为我国在此方面的制度立法提供了借鉴。
The system of Public Lending Right （PLR） and its compensation were born in the early 20th century and added into the copyright law at first in 1972 in Germany. After a long -term of system evolution and technological innovation, PLR devel- oped gradually and became a model in the copyright protection and development of PLR for the other member countries of European Union. With the multifaceted challenges of digital rights, computer software borrow, e - books borrow, copy transmission, distri- bution fairness of compensation and so on in the information age, the PLR has been faced with his changes in Germany, but also the possibility to be learned in China.
