摘要
顶岗实习环节在职业教育过程中的作用越来越重要,但其存在的劳动风险日益凸显。我国应建立学生实习劳动伤害社会保险制度来化解学生顶岗实习的劳动风险。当下,完善顶岗实习劳动保险法律制度,理清政府、学校和实习单位之间的法律关系显得尤为紧迫,并且应由三者按照适当的比例分摊成本,共同承担责任。
The link of in-post practice is playing a more and more important role in vocational education, but its labor risks are in- creasingly prominent. Therefore, in China, a social insurance system for students＇ labor injuries in practice should be estab- lished to eliminate the labor risks of students＇ on-post practice. Currently, it is particularly imperative to improve the legal system of labor insurance for on-post practice and make clear the legal relations among governments, schools and enterprises for on-post practice, who should share the cost in accordance with a proper proportion, and share the responsibility together.
