2012年3月以来,乌克兰、洪都拉斯、多米尼加、古巴和印度尼西亚政府根据某些对烟草制品和包装实施商标限制的澳大利亚法律和条例(简称"措施")向澳大利亚政府请求磋商。澳方措施并没有对烟草制品商标的注册和保护构成歧视。澳方措施对于贸易过程中的商标使用是否构成不合理妨碍是专家组裁定澳方措施是否违反TRIPS协定的关键点。对烟草制品实施简单包装的措施是为了保护公共健康,履行世界卫生组织《烟草控制框架公约》条约义务的一部分。根据TRIPS协定的条文解释以及《公共健康多哈宣言》确立的基本原则,澳方可在争端解决中坚持"措施"的正当性。本案裁决将影响WTO成员方的控烟立法和政策。
Since March 2012, the Ukraine, Honduras, Dominican Republic, Cuba and Indonesia initiated formal trade disputes with Australia through the WTO's Dispute Settlement Body, concerning certain Australian laws and regulations that impose trademark restrictions and other plain packaging requirements on tobacco products and packaging (the "Measures"). The Measures don't discriminate the registration and protection of tobacco products related trademark. Whether the Measures unjustifiably encumber the use of trademark in the course of trade is the key point to adjudicate whether the Measures are consistent with the TRIPS Agreement by the WTO panel. The Measures are for protection of public health and part of the implementation of the Framework Convention on Tobacco Control. In terms of the provisions interpretation of the TRIPS Agreement and the basic principle stipulated in the Declaration on the TRIPS Agreement and Public Health, Australia can assert the justification of the Measures during the consultation and WTO panel procedures. The ruling decisions will affect tobacco control laws and policies of WTO members.
