摘要
地理标志管理是地理标志管理主体采用法律、技术和经济手段,以过程管理为主要形式,对地理标志产业所实施的服务和技术管理。地理标志管理不但可以延续地理标志的生命,而且还是我国地理标志产业有效应对当前发展阶段面临挑战的手段,更是我国农业实现转型发展的重要途径。然而,当前我国的地理标志实践中管理缺位现象十分普遍。今后应当从法律上明确地理标志登记证书持有人的管理主体地位,借鉴外国成功经验理顺地理标志及其与其他权利的冲突,帮助地理标志管理主体搞好能力建设,多措并举帮助地理标志管理主体强化地理标志管理。
Geographical indication ( GI) management is a kind of service and technology management imposed on GI industry by GI managerial subject which takes the legal , technological and economic means and takes process management as the main form .GI management not only can prolong the life of GI ,but also can be an effective means for China's GI industry to meet the challenges in the current period .Furthermore , it is an important way for the agricultural industry in China to realize the transformational development .However,the phenomena of management absence is very common in the GI practice .In the future ,the managerial subject status of GI registration certificate holder should be clarified in the matter of law;successful experience should be borrowed from foreign countries to resolve the rights conflict between GI and other rights;the GI managerial subjects should be helped to make good ability construction and enhance the GI management .
