摘要
《土地管理法》第六十二条第一款应修改为:农村村民一户只能无偿申请一处宅基地,无偿申请宅基地的面积不得超过省、自治区、直辖市的规定。农户申请超过规定面积的宅基地,其超出部分应向村集体经济组织缴纳宅基地使用费。农户申请的超过规定面积的宅基地的使用期限参照城市建设用地使用权的期限,期满后村集体经济组织有权收回该宅基地使用权。最后,在宅基地使用权的原始取得、流转、回收的循环系统中,提出了宅基地使用权原始取得的无偿取得和有偿取得相结合制度,分析了宅基地使用权流转中的内部流转和外部流转的法律关系,构建了有偿回收、无偿回收和补偿回收的宅基地使用权的退出机制。
The first paragraph of Article 62 of the Land Management Law should be modified as.. One rural family can acquire one rural house site from the collective for free ; the area shall not exceed the provisions of the provinces, autono- mous regions and municipalities directly under the Central Government. If the rural family want to apply for the rural house site, whose area exceed the prescribed, it should pay fees and he period refers to the period of urban construction land use right. After the expiration, the collective have the right to withdraw the rural house site use right. The author proposed the original acquisition can be combined free of charge and paid in the original acquisition, transfer, recovery cir- culatory system of the rural house site use right. It also analyzed the legal relationship of internal circulation and external circulation, and develop the exit mechanism for paid recycling, free recycling and compensation recovery of the rural house site use right.
