摘要
唐宋变革之际,中国古代刑讯迈向制度化并日渐完善。其间,刑讯制度经历了由唐、五代入宋的传承演变过程。在刑讯制度表达上,唐宋刑讯工具规格、刑讯程序条件、对象条件、限制条件及司法官非法刑讯责任制等皆历经传承演变。在刑讯实践与观念方面,唐宋刑讯实践呈现出与制度表达相背离或契合的多维面向,刑讯观念亦悄然变化。刑讯制度表达的传承演变、实践的多维面向和刑讯观念的变化相互作用,共同构成了唐宋刑讯制度传承演变的独特图景,这从细微层面反映出中华法制文明的演进历程。
During the Tang and Song Dynasties, Chinese ancient torture system became institutionalized and in- creasingly perfect. In the meantime, the torture system was in an inherited and evolutionary process from the Tang and Five Dynasties to the Song Dynasty. In the aspect of expressions of torture system, the standards of torture in- struments, programs of tortures, objects of tortures, restrictive conditions of tortures and responsibility system of judi- cial officers＇ illegal acts of tortures were all in an inherited and evolutionary process from the Tang Dynasty to the Song Dynasty, In the aspect of practical activities and ideologies of tortures, torture practice of the Tang and Song Dynasties showed multi - dimensional characteristics which were deviate or fit with expressions of system. At the same time, ideologies of tortures also changed along, the interactions between expressions and practice of torture sys- tem and evolutionary ideologies of tortures formed an especial image of the inheritance and evolution of torture sys- tem during the Tang and Song Dynasties, and it reflected the evolution of the civilization of Chinese legal system from the subtle level.
