摘要
美国反恐战争中大量使用无人机,有关无人机攻击的合法性在国际上一直存有争议。本文从无人机攻击的结果出发,分析了无人机的定义及美国利用现状,分别着重阐述美国无人机攻击与国家自卫权、国家主权、国际人权法、国际人道法之间的法律相关问题,指出现有国际法在某种程度上虽不能有效规制无人机攻击,但美国要合法化使用无人机攻击,必须在《联合国宪章》下行使自卫权,尊重国家主权,严格遵守国际人权法和国际人道法等相关国际法。
The unmanned aerial vehicles (UAV) are largely used to war on terror, whose legality has been con- troversial in the world. The present article firstly focuses on the results of UAV attacks, then analyzes the defini- tion and utilization situation of the United States' UAV. Secondly it elaborates respectively legal issues of UAV attacks connecting with National Security, National Sovereignty, International Human Rights Law and Interna- tional Humanitarian Law, then points out the existing International Law cannot effectively regulate UAV attacks to a certain extent. If the United States make UAV attacks become legal, it must be in the United Nations Char- ter to exercise the right of Self - defense, and respect for National Sovereignty, strictly adherence to the Interna- tional Human Rights Law, International Humanitarian Law and other relevant International Laws.
