摘要
在准确把握物权法的立法原意的情况下,不动产统一登记条例应当明确自然人和非金融企业可以成为不动产抵押登记的权利人,并细化不动产抵押权担保范围的登记规则。在建工程抵押登记在性质上属于本登记,在建工程竣工并经房屋所有权初始登记后,在建工程抵押权登记应转为房屋抵押权登记。不动产最高额抵押的债权确定期间本属当事人可得约定的事项,对于潜在交易相对人的公示意义不大,应当作为最高额抵押登记中的非必要登记项目。
Real estate mortgage registration is an important part of the financial infrastructure. According to the meaning of Real Right Law, Regulations of Real Estate Registration shall specify that nature persons and non-financial enterprises can become the right holders of real estate mortgage. The security range of real estate mortgage should be interpret explicitly in Regulations of Real Estate Registration. Registration of buildings-under-construction mortgage is a real registration, and should be transfered into a house mortgage registration after the construction is completed. The legal period to confirm the debt in the maximum mortgage of real estate is of little significance for the potential transaction relative person, so it should be regarded as a non-essential item in the registation.
