中美高校学术不端行为处理程序的比较研究——以中美部分高校学术规范为例 被引量:12

摘要 目前,我国高校学术规范普遍欠缺阶段性程序规定。应借鉴美国高校学术不端行为处理程序,建立我国学术不端行为处理的举报、受理、质询、调查和处罚阶段性程序。这是实现主体权限划分和权力相互制约、审查程序和决定程序互相分离的基础。建构学术机构和行政机构、学术权与行政权基本分开的体制机制,详细设计由秘书长、质询委员会、调查委员会进行审查和科研处副处长、科研处处长、副校长和校长做出决定的分离程序,具体描绘保护被举报人和举报人程序权利的路径。 At present, the academic norms in colleges and universities in our country generally lack procedural provisions. No procedural requirements, it is difficult to have rights. We should stady the academic misconduct procedures of American universities, to set up the stage procedures of the report, acceptance, inquiry, investigation and punishment of China's. It is the foundation to realize the division of powers and the restriction of powers among the subjects, the separation of review procedures and decision procedures. Construct the separating system and mechanism of academic institutions and administrative agencies, academic powers and administrative powers. Design carefully the separative procedures between the review of secretary-general, the inquiry committee, the investigation committee and the decision of the deputy director and the director of research department, the vice president and the president of a college and a university. Specifically describe the course of protection of procedural rights of the accused man and the informant.
