摘要
我国铁路产业通过大量负债的方式进行大规模建设,取得了很大的成绩,也带来了巨额债务和极大的利息负担,根源在于投融资模式缺乏法律制度的规范和保障,体现为规划和决策制度缺乏严格法律程序规范,国家公共财政投资缺乏,投资主体和投资责任承担主体相背离,投资效益低下,缺乏公平竞争的市场秩序,社会资本不敢进入。我国铁路产业投融资的改革必须坚持法治化原则,针对存在的问题进行法律制度建设。
China railway industry began large- scale construction,and has made great achievements,but generated a lot of debt and a huge amount of interest. The investment and financing mode of railway industry lacks the legal system to protect and regulate,so it results in the following problems. The planning decisions lack strict legal procedures,so does the railway construction of national public finance investment. Investors are not responsible for investment responsibility. There is unfair competition order in the railway transport market,so the social capital does not dare to enter it. The reform of the investment and financing mode of China railway industry must adhere to the principle of the rule of law,and the existing problems should be regulated by the legal system construction.
