摘要
《海峡两岸投资保护和促进协议》为促进两岸投资提供了制度化、法律化的保障,其设计的创新性制度是两岸"求大同、存小异"的体现。但鉴于两岸现有的政治关系,协议中的一些规定仍然比较原则,为进一步发挥协议的作用,应制定相应的落实措施。福建省作为海峡西岸经济区的主体,可以在这一问题上先行先试,通过转变政府职能、以平潭作为试点和完善相关法规等途径落实协议的实施效果。
Cross-strait Investment Protection and Promotion Agreement provides the legal and institutional framework for the promotion and protection of cross-strait investment. The innovative system design is the reflection of "seeking common ground while reserving differences" between Mainland and Taiwan. While in view of the existing cross-strait political relations, some of the provisions of the agreement are still relatively principles. It should develop appropriate measures to implement the agreement for the expected further development. Fujian province, as the main part of economic zone on the west side of the straits, may first try on this issue through the ways of transformation of government functions, taking Pingtan as a pilot, as well as developing and improving relevant laws and regulations.
