摘要
版权问题是用户生成内容发展过程中遇到的瓶颈性难题,呈现出逐年严重化的态势。微博/博客类和视频类的用户生成内容的版权问题尤为突出。版权法保护与限制用户生成内容的发展,后者又反过来对前者的修订起着促进和推动作用。合理使用制度对用户生成内容的发展至关重要。针对日益严峻的版权问题,未来的研究将侧重于版权问题治理模式的探索与构建、版权法相关内容的明朗清晰化、新平台下的UGC版权问题。
Copyright infringement has become the bottleneck problem in the development of UGC and it presents a yearly worsening trend. The problem is especially serious when it comes to UGC of microblog/blog and video. The copyright law protects and sometimes restricts the development of UGC, meanwhile, the latter promotes the revision of the former one. Fair use principles play a crucial role in protecting creativity of users. As the infringement becomes more and more serious, researches in future would focus on the management of copyright infringement, clarity on legal provision to eliminate vagueness, and the issues under the new circumstances.
