通过参照西方主要国家的公司职工法律地位及其参与制度 ,我们看到社会主义经济制度决定劳资关系的中国职工法律地位的缺位和参与制度的弱化 ,在有关立法及实践之中尤其严重。我们应对此引起重视 ,加强公司利益和职工利益的平衡管理 ,减少劳资冲突 ,完善职工的法律地位和参与制度 ,并不断强化公司的监督和激励机制 ,促进生产效率和经营效益的提高 ,最终形成良性循环。
By comparing the legal status of staff and workers in companies in the West and their participation system, it is discovered that much remains to be desired for the legal status of company staff and workers in our country and its participation system, particularly in terms of legislature and legal practice. Therefore, due stress should be laid on this issue for the sake of strengthening the balance management of company interest and staff interest, decreasing conflicts between management and labor, perfecting the legal status of staff and workers and their participation system, and enhancing production efficiency and business benefits, etc.
