摘要
随着知识经济和高新技术的发展 ,技术开发合同中的风险责任问题日渐增多。本文从技术开发合同的特点入手 ,分析了当前司法实践中对技术开发中风险责任认定的不同观点 ,阐明了认定技术开发合同中风险责任的三个条件 。
With the development of knowledge economy and high technology, problems of risks and responsibilities in technological development contracts are becoming more and more. The article, starting from the characteristics of technological development contracts, analyses different ideas about this matter in judicial practice, demonstrates three conditions and puts forward some solutions.
