摘要
对当前医事纠纷在运用诉讼程序解决中的几个特征作了扼要的论述 ,针对其中存在的问题作了剖析和探讨 ,进而强调医事纠纷是一种特殊性质的民事纠纷 ,处理时应当结合国情和生产力发展水平 ,并制定相应的法律法规 。
This paper deals with legal nature of medical act, legal principles to be followed, legal relation in medical dispute, means of solution of medical dispute and several characteristics in the procedure of medical lawsuits. The paper also presents analysis and discussions on the problems involved. The author emphasizes that medical dispute is a special kind of civil dispute. To solve the problem laws and regulations should be established and perfected with reference to the present condition of our country and the level of the development of productivity.
