摘要
图书馆数字资源采访有很多方式,所面临的著作权风险并不相同,但归纳起来主要有合同风险与侵权风险两大类。合同风险主要包括合同主体资格是否适格、合同标的是否合法、合同许可范围是否清楚等方面。侵权风险则存在直接侵权和间接侵权两种形式。整体而言,预防图书馆数字资源采访中的著作权法律风险应从强化注意义务、提升馆员法律意识和充分利用著作权的免责条款等方面着手。
Though library digital resources acquisition has in many ways and every way contains different copyright risk, which can be summed up in the contract risk and the risk of infringement. The contract risk mainly includes whether the contract subject is qualification, the contract object is legal, the contract scope is clear. The risk of infringement can be divided into di- rect and indirect infringement. As a whole, the prevention of the copyright legal risk in library digital literature acquisition should nay attention to the duty of care. improve librarians＇ legal consciousness and make full use of the Clause set in copyringht law.
