政治问题原则在美国气候变化诉讼中的运用 被引量:8

摘要 政治问题作为不受司法审查的判准,是由权力分立而导出的司法权的界限。无论是政治问题原则的古典形式还是审慎形式,一直都备受争议。在美国司法审查实务中,政治问题原则的适用较为谨慎,适用的领域也相对固定。是否应超越政治问题原则的传统适用领域,在气候变化诉讼中运用该原则,联邦法院并未达成一致,对于气候变化诉讼请求是否存在政治问题也作出了不同判断。导致这一分歧的因素是多方面的,其中环境保护和美国能源政策所追求的其他利益之间的难以平衡,最为关键。此外,政治问题原则的适用与起诉资格审查的宽严有着此消彼长的关系。 The political question doctrine is a criterion of political questions which is not subject to judicial review.It is the boundary of the judicial power based on the idea of separation of power.Either the classical or the prudential form of the political question doctrine has always been controversial.In the U.S.practice of judicial review,it is very cautious to apply the political question doctrine,and the field of application isalso relatively fixed.The Federal Courts have not agreed on whether the political question doctrine should be used in climate change litigation beyond the traditional fields of its application,and have made different judgments on whether there exist or not political questions in claims.There are many factors leading to this divergence,among which the most critical is that it is difficult to balance the environmental protection and other interests pursued by the U.S.energy policy.Besides,there exists a reciprocal relationship between the application of the political question doctrine and standing.
