摘要
2012年我局行政执法人员对某餐饮服务单位进行日常监督检查时,在操作间冰箱内发现已开封使用的复合食品添加剂"香甜泡打粉"超过了保质期。经合议后决定对该单位进行处罚,但在适用法律时发生争议。本文对此进行探讨,分析餐饮服务单位使用超过保质期的食品添加剂是否应适用超过保质期预包装食品处罚条款进行处罚,以避免今后出现错误。
The administrative law enforcement officials found that a compound food additive,named sweet baking powder,was beyond warranty period in a hotel,while conducting daily supervision and inspection in 2012.After panel discussion,the executive branch decided to punish the hotel,but dispute in law application.This paper discusses of catering units using food additive beyond warranty period should apply the article of prepacked food beyond warranty period to avoid errors.
