摘要
澳门回归15年,特区政府秉持"教育兴澳"的施政方向,大力发展高等教育,取得了令人瞩目的成果。回眸澳门高教治理的历程,无论是高等教育辅助办公室的重组,还是单独为澳门大学设立法律制度,特区政府一直尊重高教发展的多元特色,奉行"无为而治,各显特色"的治理理念。然而,在宏观治理下,公立高校被定义为公法人,须受到适用于公法人的公共行政法规制度的约束,这显然已经成为澳门高校发展的瓶颈;而在内部治理中,高校则形成以决策为边界的治理架构,充分体现了章程治理的内涵。展望澳门高教治理的未来,适时调整公立高校公法人的身份至关重要。可以参照葡萄牙模式,推行私法制度下的公共基金会模式;在政府和高校间设立中介组织;同时实施对高校的问责机制,充分实现社会价值平衡。
During the 15 years of Macao＇s return, the government developed higher education with great effort, and had achieved gratifying successes. When looking back to the process of Macao higher education governance, the government attached very great importance to the multiplex peculiarities both from the reforming of Tertiary Education Services Office and from singlehandedly setting up the legal system for University of Macao, to pursue the governance idea of ＂self-control ＆ self-management, distinguishing features＂. However, the public institutions of higher learning are defined as Public Legal Person. So these institutions were subject to the restraint of public administration system which fitted Public Legal Person that had become the bottleneck of the development of higher education under macro-governance. On the other hand, the institutions of higher learning had developed the governance structures by taking decision-making as boundary which could fully reflect the connotation of the institutions charter under micro-governance. Looking forward to the future of Macao higher education govemance, it is very important to adjust the identities of Public Legal Person for the public institutions. Referring to Portuguese pattern, public foundations under private law should be operated as, and intermediary organization needs to be set up between government and institutions. Simultaneously accountability should be implemented to all institutions to realize the balance of social value.
