摘要
中日四点原则共识为东海共同开发带来了新的契机。《中日东海问题原则共识》本身并非正式的共同开发协议而是其准备性法律文件,在缔结形式和具体内容上需要进一步细化。钓鱼岛问题和防空识别区问题是目前阻碍东海共同开发实现的两大桎梏。中方应当坚持以原则共识为基础展开后续谈判,致力于在后续谈判中达成涉及具体权利义务的、能够在一段时期内平衡和保障双方利益从而令双方均具备主观执行意愿的共同开发安排;阐明中方对于钓鱼岛的主权立场,同时确认中日双方在钓鱼岛的主权问题上存在争议,主张在共同开发安排中忽略钓鱼岛的法律效力;坚持本国划设防空识别区的权利,阐明防空识别区的法律性质(作为自卫权间接准备措施的必要技术信息管控),指出相邻或相向国家之间防空识别区存在重叠乃是正常现象,不妨碍海上共同开发。
The four principle consensus between China and Japan casts new light on the joint development in East China Sea. The 2008 Sino - Japanese Principle Consensus of East China Sea does not amount to a binding agreement, and possess certain defaults in procedural and substantial matters. The issues of Diaoyu Islands and Air Defense Identification Zone are the shackles of joint development. China should continue negotiation based on the 2008 Consensus and make affords to achieve a binding arrangement with detailed rights and obligations ; to confirm the sovereignty - disputed situation of Diaoyu Islands and suggest ignoring its legal effects in joint development arrangement; to clarify the legal nature of Air Defense Identification Zone and point out that the over- lapping of such claimants shall not hinder the joint development.
