摘要
美国为了防止侵犯幼女性权利的罪犯再次犯罪,在历史上的不同时期采取了不同的做法。20世纪30年代,美国曾使用外科阉割,直至今日,美国一些州的立法还保留了这一刑罚手段。由于多种原因,很少对罪犯实施,而代之以化学阉割。目前,化学阉割已经被美国多个州采用。从外科阉割到化学阉割的转变过程经历了多个发展阶段。从外科阉割到化学阉割的转变过程中伴随着美国法治的发展和博弈。
In history, US adopted surgical castration to cope with the recidivism of sexual offenders. Up to now, there are some states conserving surgical castration in their statute. Due to various reasons, it has not been used to the sexual offenders for a long time. The chemical castration is another constitution to prevent the recidivism of sexual offenders. From the surgical castration to chemical castration, the transition contains the development of American rule of law and the balance between different authorities.
