摘要
基于频发的食品安全事故,借鉴现已运行成熟的机动车交通事故责任强制保险的实施经验,提出建立强制性食品安全责任保险制度。当前已经具备法律基础、理论基础和实践基础,尝试从保险主体、保险客体、保险产品、保险费率、责任范围、赔付方式和限额等方面勾勒强制性食品安全责任保险制度的框架体系,并提出具体的推行该制度的建议。
Based on the food safety accidents happening in endlessly, using the motor vehicle traffic accident liability compulsory insurance run- ning maturely for reference, mandatory liability insurance system of food safety was proposed. The current implementation has legal basis, theo- retical foundation, practice basis, and attempt to draw the outline of the framework from the insurance subject, insurance object, insurance prod- ucts, insurance rate, limitation of liability, compensation methods and quota, several suggestions for the specific implementation of the system were put forward.
