摘要
体育赛事节目是创作成果,创作对象的属性并不影响创作成果的可版权性。在知识产权制度日益国际化与一体化的当下,著作权与邻接权区分的意义日益消减,作品与制品的界限日益模糊,我国著作权法应该取消制品概念,将体育赛事节目统一纳入著作权中进行保护。作品的本质是符号的排列组合,视听作品的本质是系列图像的排列组合,从作品本质的角度讲,体育赛事节目属于视听作品的范畴。在体育赛事节目的创作过程中,导演对摄像机位所拍摄的镜头进行了取舍与编排,基于这些取舍与编排,体育赛事节目满足原创性要求而能够获得版权保护。
Sports telecasts as a kind of creation shall be subject to copyright protection albeit sports events, the subject matter of sports telecasts, are not subject to copyright protection. With the internationalization and integration of IP system, the copyright-related right dichotomy has lost its initial essence. The dividing line among the recording and production has become increasingly blurred. In Chinese copyright law, the term recording should be ignored. The sports telecasts which are original should be copyrightable works. Works are the arrangements of signs. The audiovisual works are arrangements of series of images. Basing on the essence of works, sports telecasts should be under the regime of audiovisual works. The originality of sports telecast owes its origin to the selection and arrangement of the images by the director.
