摘要
集体所有制土地是农村集体资产的主体部分,把土地承包经营权分设为承包权和经营权,实行所有权、承包权、经营权"三权分置",是农用地产权制度演变的大趋势。发挥好"三权分置"的积极作用,预防可能带来的负面效应,关键是要合理界定农用地所有权、承包权、经营权的权能范围,把三者各自的具体权利一道道界定清楚。从近30年的不断分割过程中可以看出,土地承包关系实现了从合同约定向国家赋权的重大转变,家庭承包经营实现了从生产经营责任制改革向产权制度改革的重大转变,土地承包经营权实现了从生产经营自主权向用益物权、乃至"准所有权"的重大转变,农用地所有权与承包经营权分离的制度框架基本定型。要按"三权分置"的思路重构农用地产权体系,与此同时,应防范"三权分置"可能带来的负面影响。
Land of collective ownership is the main partof rural collective assets. It's the general trend of farmland property right system evolution by dividing land contract management rights into contractual right and management right, and separating ownership, contracting right and managing right. To maximize the positive role of 'separation of rights' and to give precaution to possible negative effects, it is essential that the definition and boundary of farmland ownership right, contractual right and management right be reasonable and distinct. The constant segmentation of the past 30 years witness the realization of land contracting relationship assured by contracts to rights conferred by nation; household contract management transformed from production responsibility system reform to property right reform; land contracted management right also evolved from production and operation of autonomy to usufructuary right and even 'quasi-proprietary right.' The system frame of the separation of farmland ownership and contractual management right has been fundamentally established. We should reconstruct farmland property relationship system guided by 'separation of rights,' and meanwhile, we should giveprecaution to any potential negative effects of the 'separation of rights.'
